change of marital statusWhat is the name of your state?NY We filed married jointly previously and received a state tax refund. We are now filing separately this year. How do we treat the refund. Is it half for each of us. |

| If you file separately each person will receive a refund (or more likely pay a balance due) based on their own income & tax payments.

| If your question is how much of last year's refund is taxable to each of you, I believe each of you would have to claim half of the refund as income, but only if you itemized deductions last year. If you used the standard deduction, the prior year's refund won't be taxable to either of you. And Abezon is correct. You'll probably owe more tax by filing separately. Snipes |
