What is the name of your state? I live in ca. My ? is if I have 51 phyical costady in the legal papers but my ex will not let me see our dauter can I still write my dauter off as a dependent?

The parent with whom she spends 51% of her time may claim her on a tax return. This is actual time, not hypothetical time listed in court papers, sorry.

Sounds like you should take the ex back to court.

Unless the court papers award the dependency exemption to you, in which case you can claim your daughter whether she lives with you or your ex.
