What is the name of your state (only U.S. law)? MS
My daughter's fiance and his son has been living with her for the last 8 months. They moved in when his job played out and he cannot find another job. He is also unable to collect unemployment benefits. Can she claim them on her taxes?

No, unfortunately not. An unrelated individual must live with you for the full 12 months of the year in order to be claimed as a dependent on your tax return.
