| | | Claiming my girl friend as a dependent. Currently living in Oklahoma.
I moved here from Texas at the begining of the year for work and my girlfriend moved with me. She was employled for a short period in Texas, but has not been employed the entire time in Oklahoma, so i've been paying her car payments and all her living expenses.
Can i claim her as a dependent with out any risk of being labeled common-law marriage and all the complications that may go along with that, or am i stuck with just claiming my self? |

There are four tests that must be met for a person to be your qualifying relative. The four tests are:
Not a qualifying child test,
Member of household or relationship test,
Gross income test, and
Support test.
Age. Unlike a qualifying child, a qualifying relative can be any age. There is no age test for a qualifying relative.

If a person has resided in a household maintained by you for the entire calendar year, and has made less than 3400.00 in income, and cannot be the qualifying child of someone else then yes, they are your qualifying relative, even if they are not actually related to you. | |
