What is the name of your state?Missouri.
I was Divorced last year, in our degree it states we switch tax years.I repeatedly told my attourney he did not qualify under federal laws to claim, but it was finalized with that condition anyway  .We have joint custody with me having primary. My question is :We have one child and he dosent pay his ordered support for 3 or 4 months out of the year and makes excuses so he only takes him about once a month. So can he still claim him on his taxes? If so is there away I can get this corrected? Any suggestion is greatly appreciated :)

If the decree says he can, then he can.

Yes, you can get this corrected by going back to court.
