I work for an Arts and Entertainment seasonal event (Renaissance Festival). We are looking to contract a group of performers from Canada. The entity being contracted represents itself as incorporated, presumably in Canada. Am I correct in assuming I need to ask them to provide a form W-8 prior to making payment? If so, would I request a W-8EXP or a W-8ECI? And how do we determine whether they are subject to the 30% withholding? Does receipt of the W-8 dictate that we do not withhold?
