Dependent Care

What is the name of your state?TX

I have a friend who's ex has custody of their kids. They were never married and he was ordered to pay child support. Per the order, the only way he can claim the children as dependents is if he's caught up on payments and he is not. His ex will not allow him to claim the amount of daycare he paid over the year because she said that he didn't follow what was ordered. Can she do this or can he still claim the child care expenses without claiming the dependent?
