I had my employer withhold money for a dependent care FSA account in 2004. Because my wife didn't have any earned income for 2004, it looks like I won't actually be able to deduct this money.

During 2004 my wife was originally unemployed (and collecting unemployment) and later started working for AFLAC insurance as an independent contractor. We put the child in day care during her AFLAC employment. Unfortunately, her employment was not very fruitful and she had an overall loss of aproximately $800.

There are exceptions to the earned income provision for full-time students and the unemployed. Is there an exception for my wife's case? She wasn't simply idle and going to the country club (which is what I assume the earned income provision is meant to prevent).

Any help would be greatly appreciated. :)
