Divorced parents claim same dependent


State: Connecticut

My husband has been divorced since 1998 & has 2 children. His divorce agreemnt states that he is entitled to claim one of his sons on his taxes, his x-wife claims the other child.

We just received a notice from the IRS stating that two tax returns they received for year/2000 claimed the same child. (We know it is his x-wife). However the IRS letter states that if we believe we are "entitled" to the claim then do nothing, if we are not entitled to the claim we are to fill out the enclosed "Amdnedment" form.

I would like to clear up this matter with the IRS and leave it pending. I would like to send them the copy of the divorce agreement showing proof that he is entitled to claim that child and not the x-wife (or) should I wait it out? What is your suggestion to clear up this matter immediately.

It sounds like the IRS is trying to clear it up. They probably sent the ex wife the same form. If the ex wife amends her return, that is the end of the matter. If she does not, then they will ask you for proof that you are entitled to the deduction. I think you will probably just complicate the process if you send in anything at all at this time.
