My Husband is in H1,we have a son-2 years old.
We didnt claim EIC for the year 2004 as I didnot have a SSN.
Now I got my H1 and SSN, Can I claim the EIC now, If yes , whats the procedure.

Do you have an SSN or an ITIN?
You can only get EIC if you were a US Citizen or Resident Alien (Green Card Holder) for the year in question, and both parents must have SSN's. An ITIN for either of your or the child will disqualify you.
