employer/state withholding questionWhat is the name of your state? new york my husband lives in new york and works in new jersey. we were informed that his employer is now going to be withholding tax for the work state and the residence state. (they had an option to do this by filling out a form, but we need the money, so we chose not to fill it out). my question is, can they do this legally? i thought it was my responsibility to pay my taxes! |

| They are required by NJ law to withhold taxes for NJ. I doubt they are required to withhold for NY, but it appears they're gonna. Maybe you should fill out that paperwork pronto declining their generous offer to rob you paycheck on behalf of two states. It's your responsibility to pay your taxes during the year. If you owe the feds more than $1,000 (usually $500 for states), you get socked with penalties for underpayment.

| Alot of employee's prefer to have their work state and resident state tax deducted... Only the work state "must" be deducted I'd contact the payroll dept and let them know I only want my work state deducted..I'd ask them if it's a law.. I don't think it is..only Work State is mandatory..the resident state can be paid by the employee at the end of the year GOOD LUCK ~~~~~~~~~~~~~ From my experience..always check the laws to be sure |

| i'm having the same trouble with my employer.they are taking out 3 different city taxes in 2 different states, but not taking out 2nd state taxes. i'm worried that the 2nd state, which i dont live in will want their tax at the end of the year.They have estimated time spent in the 3 cities and thats all i am being taxed. we dont know if they can do that legally.witholding 3 cities in 2 states and not witholding 2 states? |

| Some local taxes must be deducted like in PA they a gazillion local taxing juisdictions. The best thing to do is call the state agencies themselves even the local agencies and ask them directly whether or not your being taxed correctly I'm pretty sure you must have work state taxes deducted, unless of course you work in a state that does not have state tax like Fla...or Texas GOOD LUCK !!! ~~~~~~~~~~~~~~~~~~~~~~ Always check the laws...Going directly to the source is good to |
