Error 515 -- question

What is the name of your state? MD

Greetings,

I filed via taxact on April 14th. I filed jointly. I did not have a SSN for my spouse so I just made one up. Of course it was rejected.

I applied for a taxpayer ID number for my spouse and got it 6 weeks later.

I applied again via taxact, filling in the right info, taxact accepted it. 3 days later I get a note from them, that it was rejected by the IRS.

They seem to be saying that I already filed my taxes? But then why was it rejected the first time on April 14th? What should I do at this point?

Federal Return Status Information:

Federal Return Status:
Rejected

Federal Return Rejection Information:
This Federal Return was rejected by the Internal Revenue Service on 5/31/2008. This Return was rejected due to the Error Code(s) shown below.

Form/Schedule: Form 1040 - U.S. Individual Income Tax Return
Form Copy: 1
Error Code: 515
Error Code Explanation:
The Social Security Number for the primary taxpayer on this return has already been used on a return filed with the IRS for the current year.

IF your Federal return has already been accepted, see below to submit just your state return.

Whether the cause of this rejection is the result of a typo on another return or an attempt by another party to claim your primary social security number, the IRS has security measures in place to ensure the accuracy of returns submitted. You are entitled to file your return correctly. If you have verified this primary social security number and found no errors, you need to file your return on paper. You should attach documentation supporting the social security number in question and a copy of the e-file rejection notice.

If you are filing a STATE return, you can repeat the Filing step and choose STATE ONLY (except HI and AR) to resubmit your return.

Review your entries in Basic Information.

In order to electronically file this return, please correct the error(s) shown, then re-transmit the return using TaxACT. This return will not be billed a second time for a re-transmission. If, for some reason, the error(s) cannot be corrected, you will need to use TaxACT to print and file a Federal paper return.

Well, since you knowingly submitted a false return - perhaps you should see a tax professional to help clear up the mess you made.

Yeah, you are being oh so helpful by restating the obvious.

I found my answer here:

Error code 0515 indicates that the IRS already has an accepted return on file for your SSN. There are two common causes of this error: 1) you have incorrectly entered a SSN on your return or 2) you already filed a return with another company or paper filed. If you are trying to file an amended return you can not do this electronically. You can use our service to prepare an amended return, however you would need to paper file Form 1040X. Please first verify the information you entered for this individual to ensure it was entered correctly.

You had to send in a paper tax return in order to apply for the ITIN number, therefore your taxes have already been filed. You filed them via the paper return.

Interesting - I had no idea. But it's true - I sent in that 1040 form to justify the ITIN number. I didn't realize it would constitute tax filing.

If it wasn't an accurate return, you will want to do an amended return. That has to be done by mail as well.

Thanks.
It was an accurate return. It was just missing the ITIN number.

You are right, they file for you, filling the number in.

The IRS will review the documents, issue the ITIN, insert the ITIN in the blank SSN area, then process the return. They will send you the ITIN under separate correspondence. This process normally takes 4-6 weeks.

Yes, I know I am right. I am a tax professional who prepares many returns like that, every year.

Yeah, and thanks for the contribution to this matter.

Do you have an idea when the tax return I filed should arrive? I filed for ITIN (and included a complete and accurate tax return) in mid April.

Next year, with TaxAct should be much easier.

It takes 4-6 weeks to get the ITIN number, and then your refund should come another 4-6 weeks after that.
