What is the name of your state? Oregon
Hi,
My husband is US citizen and works in Texas. As per last year I was on student visa, working in Oregon. I am still on student visa, with green card under process.
The question is: We plan to file the federal tax as Married-filing-Jointly.
And since there is no state tax in Texas, I will be filing my state tax return in Oregon with status as married-filing-seperately. Is that legal to do so.

OR allows couples to file separately if they have different residence statuses during the year. You will file as a resident or part-year resident. Your husband files as a nonresident (& does not have to file if he had no OR-source income).
