Filing return for 2004???What is the name of your state?MA I have to leaving for good to India in this November because of some family reasons. I will be resigning the current employer in US. My questions are 1) Will I be able to file a return for this year while I am out of US. 2) Will I receive W2 (which I normally get in Jan of next year) this time? If I am going to get W2, I might file with e-file. Please correct me if I am wrong. I will really be greatful for any of ur help. Thanks AA |

| You can file from India -- just download the tax forms off the web & fill them out. However, you'll probably do much better to find a tax preparer near the Canadian border who deals with tax treaty & international issues. the type of visa you have & how long you've had & how many days you were in the US in 2001, 2002, & 2003 are crucial factors. You may have to file a dual status return, or as a full year resident or non-resident, may want to make certain elections for 2004, etc. The answers to these questions may dramatically affect your return. You will receive a W-2 as usual, but be sure to leave a forwarding address. How long does mail to India take? You might have your W-2 sent to a friend who can fax it to you or your chosen tax preparer. I'd also recommend you see a tax pro about filing a 1040C. This is a tentative tax return filed by departing aliens which shows that their withhholding is adequate to cover their tax liability. If you don't have the form prepared, US customs can fill out one for you (and make all assumptions against you getting a refund) and make you pay extra money before they release your possessions/bank accounts.
