Filing statusWhat is the name of your state? Colorado My husband and I are in the process of a legal separation. We have agreed to stay married at least for the next three years whether we reconcile or not. During this time can we still file as married filing jointly? |

Filing StatusA couple that is legally separated, and live in separate houses, is unmarried for income tax purposes, and, therefore, cannot file Married Filing Jointly - you would file as single. This assumes there is real "legal separation" in your state. If you have kids, then one of you may file as head of household - depending on who they reside with. |
