What is the name of your state? CALIFORNIA

If a spouse dies and leaves everything to the surviving spouse through a living trust, and the value is over $1.5MM, does the surviving spouse have to file a form 706?

Yes. If the surviving spouse got $1.5M, s/he can afford to hire an estate attorney. In fact, s/he probably can't afford not to hire an estate attorney.
