Gift Taxes


If some one gives a house as a gift, are they required to inform the recipient of the gift whether the estate tax has been paid or not? Is it possible to find out through other means if the donor does not want to divulge that information? If the donor dies without paying the gift tax and his heirs are liable for that tax can they contest the gift? Texas resident.

Only the gifter is responsible for paying gift tax. There is no gift tax due unless the gifter has exceeded their lifetime exclusion for gifting (currently at 1 million dollars).

The donor's estate would be responsible for any unpaid tax...gift or otherwise.
