Gifting - who can?What is the name of your state? Our state is Pennsylvania. Question is: Can a daughter, who has power of attorney, gift $11,000.00 to herself and 2 other siblings - because mother is 94 and not mentally able? And, if mother passes away within that year are there any tax consequences? |

| Get a court to approve the transfer. If you give yourself $$, it's self-dealing. The court will probably just approve it, if each child is getting the same amount & the gift is intended to avoid estate taxes.
