Guardianship and DependentWhat is the name of your state? TX My husband and I have had Temporary Guardianship of a minor child (now age 14) for the last year and have executed another power of attorney with the bio mother for another year. We have received no financial support from either parent for the entire time he has lived with us. Mother is indigent having just been released from prison and dad is currently serving 7 years for Probation Violations. Can my husband and I claim him as a dependent on our Income Tax? |

| Yes. He is your dependent foster child. For child tax credit purposes, you'll have to read the definition of foster child. Last year, foster kids had to be related (sibling or descendent of sibling) or be placed in the home by an authorized placement agency. I've hear rumors the definitions are changing this year. Will know more next week after I read all the stuff......

| I read the same thing when I went digging. They are recending the "legal agency" and wording it to include something like "or a parent who has the right to place the child for legal adoption." I wanted to double check. I will be watching for your other replies as I'm sure you will have the new tax codes before I will have time to dig again. Thanks! |
