My husband and I have been separated since May of 2003. He says that because we are still married we have to file together. Is that true?

Nope.

You have three filing statuses available to you, depending on circumstances, if you are legally separated.

If he moved out prior to July, and you had children living with you, you can file as head of household.

In that case, he would have to file as "married filing separate".

You also have the option of married filing separate if you did not have children living with you.

Your other option is to file with him as married filing a joint return.
