Hi,

Here's my situation. I'm divorced with 3 kids. My ex does not work and she
has the kids most of the time. It is agreed upon that I'll be claiming the kids
as dependents. Some of my kids stay with me when they are not in school.
so can I file as "head of household"? If I can and if I'm audited, what kind
of proof do I need to have?

Only one of you may claim HOH. If she claims as well, the audit will need
proof of more than 6 months in the home.

If only one files... there probably would be no need for audit.

My ex and I were 50/50 and it was a toss up of who would get the HOH claim as it was well... 50/50. we would do our taxes and see who would benefit more and then split the difference. we did not feel we were cheating the government because only one would claim HOH and we both actually were.
