Ohio is the name of my State
Am I able to file head of household if I am married and my husband just recently can home from prison and is now back in a half way house as of Sept. 04. Was home from Jan.04 until Sept. 04. He had income of about 4,000. I have a daughter to claim but can I claim him as a dependent also and file his taxes separately, as someone can claim you as a dependent. Thanks.

No.

If you are married and he lived in the home at any time during the last six months of the year calendar year, your options are married filing a joint return and married filing separate.
