i have not received 2001 w2 from sued employer

colorado i am currently in the process of taking my former employer to small claims court but i haven't yet received my w2 from 2001 to file for taxes. she says i can't have them until after court, is this true, i thought employers were required to send them out by january 31st? i am taking her to court over an unpaid paycheck from 2001.
