What is the name of your state?new york I have a tax question. My fience was awarded claiming two of his kids on income tax return. When we file 2006 for 2005, we won't yet be married - can we each claim one child?

When we do get married, if we file married, filing separate, can we each claim one child?

I guess really what I am curious is - - can I claim one of his kids? He said he doesn't mind - - we figure might mean higher refund if done separate, but not sure..... we'll probably work it out both ways to see which works in our favor better.

If I claimed before we're married, does it matter?

Anyone? With everyone's knowledge -I am sort of surprised that no one knows if this would be legal for me to do or not!

I am (well, we are) curious as to whether or not it's ok

If they live with you, maybe. If they don't live with you, no. And that only applies for 2004. Rules will change to your further detriment in 2005.

In January you won't be able to claim them at all, whether they live with you or not, unless of course you married their non-custodial parent.

A non-custodial parent can't "designate" someone else to use a child's exemption, period.
