Injured Spouse Document???


What is the name of your state? California
Can anyone tell me exactly what an "injured spouse form" is designed to accomplish?
I owed taxes from back in 96, and Im payning them off with an installment agreement.
It was suggested that my husband and I file and injured souse form to keep the IRS from taking my husbands tax return this next year. (These 96 taxes were from prior to our marriage, and i have not been employed since we married).
Thoughts?

The injurred spouse form is designed to split the income, taxes, deductions and credits according to the spouse to whom they belong. Since you are in a community property state the IRS would be able to assign 1/2 of your husband's income to you.

What you need to do is have your tax preparer run the numbers both ways, as your husband filing married filing separate, and you filing a joint return with 1/2 of the income attributed to you.

Then you can decide what is the best way to file.
