LLC or independent contracter?

I live in Wiscosin. In april my friend and I formed a LLC logging companied. After the LLC was formed, my friend refused to honor it. He put All contracts, insurances, licenses etc. in his name. Money to pay employees (truck driver) was deducted from my check, but no sttement of the actual amount. Money for insurance, licensing etc was also deducted. I was paid by check out of his personal account so no stubs are available. Since he reused to honor the LLC agreement, We have separated. Now he refuses to provide me with a w2 or earnings statement. Do I file as an LLC or Independent contracter?
