My husband has had primary physical custody, and in August of 2003, received sole legal and physical custody of his two kids. During that time, his ex wife was in Florida and filed income taxes, of which, she stated she had her 2 kids for at least 7 months of 2003 (not true). We have just gone through a modification of custody and such, which she pursued, and lost, but her papers from our lawyer which we asked how much time she lived with her children in 2003 states 0 months. The tax forms show otherwise, can we turn this into the IRS for fraudulent acceptance of income taxes. She didn't have her kids at all, in fact, was 1200 miles away from them in Florida. Can something be done?
