Medical ExpensesWhat is the name of your state? Virginia My husband and I have been separated since June 2003, there is no legal documentation. We are probably going to be filing separate returns as it would be better for us both instead of joint. If we do it separately I would have enough medical expenses to deduct. My question is can I also claim his expenses since we are still legally married as long as he is in agreeance with it?? I have the house and all to claim also, has he is living with his father rent free so he wont be able to itemize. Thanks! |

| If you are married filing separately and one of you itemizes, the other is also required to itemize, even if they have to list zero for itemized deductions. See a tax professional. If either of you is supporting a child, you may be able to file as head of household. The bottom line on medical is that you may generally claim medical expenses for someone who is currently your dependent, or who was at the time the expenses were incurred. A spouse is not a dependent, but you MAY be able to claim those expenses. However, MFS is rarely a "good deal", so I would bring all your information, and your spouse's, to a professional and see what the pro has to say about it. Snipes |
