Our temporary divorce agreement went into effect in Nov 2003. I was given temporary custody of the house and ordered to pay the mortgage beginning Jan of 2004. On Sep 20 of 2004, my husband was awarded the house but I was allowed to live there and ordered to make the payments for the rest of 2004. He took custody of the house on Jan 1, 2005.
Am I allowed to take the mortgage interest deduction?

On the face of it, yes, since you made the house payments, and were legally responsible for them at the time.
