I moved to the UK in March of 2008. From January until the time I left I made $15,000.00 in the US. I have not worked in the UK since moving here. My husband is a British citizen, and works full time. I must file a tax return for my income from 2008, but do I include his UK earnings as well? We have 1 child age 9. I'm not sure what forms need to be filled out, which credits I am allowed to claim, and what my status would be since I was only a resident of NYS for 3 months. What is the name of your state (only U.S. law)? |
Is your husband a US green card holder? If so, he is required to report his UK income on his US tax return, however he will get a pro-rated foreign income exclusion (complicated to do, you need a tax professional) and/or credit for foreign taxes paid.
You would file a part year return for NYS.
You could look for someone in the UK with experience dealing with US tax returns for ex-pats (the US embassy may be able to recommend someone) or you could work with a professional in the US via email and fax.
If your husband is not a US green card holder then you would need to file a separate return.
