My former employer hasn't sent me my W-2

Hi,

I haven't received my W-2 from my former employer. I believe the law states that all W-2's must be sent to the empolyee or ex-employee by January 31st. Is there anything I can do to receive my W-2 from them? I've already contacted the HR to no avail... Do they run the risk of a law suit by not providing me with my W-2 on time?
