possible tax lienWhat is the name of your state? california I have not filed taxes since 1999 due to the district attornys office assuming I was involved in a conspiracy they were investigating, and had my home and office searched and seizing all paper work pertaining to business and expenses, would not let me even make copys for tax purposes until this year, and when they did, they were missing half of the boxes of documents, they have 99,2000,2001 documents, I was late on my taxes at the time and have not filed since for fear of not filing for those three years, now the ca st tax board is demanding I pay them $7000.00, where do they get that figure, i could owe them more or less ? this criminal case that i am involved in will go to trial in feb or march of 2004 and at that time I can get my stuff back do my taxes, my question is how do I hold them off ! they are going to put lien on my propertys and attach my wages. if I could afford to just pay them I would. living paycheck to paycheck. |

possible property lien....am i missing something...? do you not have an attorney working on your criminal defense? can you not ask him what to do about your tax situation? if you are facing criminal charges, perhaps with prison time if convicted, then why worry about the state tax collectors now? i would suggest that you contact an attorney, and probably transfer the property to some other person if you might be convicted or cannot pay the state tax collectors...get good legal advice. |

elvapetHi , no I am not the criminal, and do not plan to go to prison, concidered a hostile witness for the district attornys office only, they would love to discredit me in any way they could, so I do not have an attorny, questrions are, how would I transfer the house to someone else? without my mortgage company finding out and calling loan? and should I call and tell the ca tax collect the whole story? or should I just wait it out? I dont know what to do. |

| If you know what documents are missing, you can probably call the original providers (employer, mortgage company, charities) & request copies. Then you can file your taxes. Once you file, you know how much you owe or get in return. Even if you don't have all info, you can file returns & amend them. I suggest you hire a tax preparer to help you. The reason CA thinks you owe money is that they have 'dummied up' a return for you which assumes you have no itemized deductions, then figured out what you owe, then tacked on interest & penalties. The interference of the state (prosecutor's office) might be good reason for the state tax board to forgive any penalties. At any rate, if you owe less taxes, the interest & penalties will drop, as both are based ont he amount of taxes you owe. If the prosecutor's office lost some paperwork that can't be replaced, you could sue them for the extra taxes you had to pay & for the penalties & interest you have to pay because you couldn't file. However, you'll have a difficult time proving anything and an even harder time convincing a jury to award you damages, since the jury is made up of people who pay taxes to the county.....
