Privacy of Tax ReturnsWhat is the name of your state? What is the name of your state? Texas I live in Texas and file a joint return with husband. Husbands ex wife lives in Georgia and has filed a contempt charge against hubby (13 years of peace and she files 10 months before support obligations end). Have made 3 offers to settle - ex does not respond nor have we received what she claims the arrears amount to. Ex is going through the Department of Human Resources in Georgia. The DHR has demanded release of the last 5 years of tax returns. I have told our attorney in Georgia that I oppose my financial info being released. I have been told "tough" - DHR demands any and all financials/assets that are jointly owned . Does the Georgia DHR have power over my financials even though I do not reside in Georgia ? Do I lose my right to privacy because I married a man with a child from a previous marriage? What laws are on the books to protect me? What if DHR gets my financials and makes them public record? Thanks -appreciate any suggestions/advice |

| Yes. Yes. No. You can ask the court to seal the record of the tax return. Also, you can remove you social security number from the return so that anyone who gets access to the court file can't find out your SSN. Many jurisdictions are considering having SSNs filed on a separate declaration that can be sealed so that most of the court file can be public but people's identities can't be so easily stolen.
