| For most people, your tax home is where you live & earn $$. For your husband, it's overseas. For you, it's Texas. You'll file a joint return with a 2555 or 2555-EZ to exclude the foreign income. Since TX doesn't have income tax, you only need to file a federal return (assuming you work in TX). If the $80,000 foreign earned income exclusion does not exclude all your husband's income, he may also be able to claim a foreign tax credit for taxes he pays overseas, and employment expenses. Both these amounts would have to be prorated based on how much income he excluded & how much he earned total.
