Separated / Husband filed federal without my knowledge


What is the name of your state? AZ
I had to leave my home in Arizona due to foreclosure. I am also now separated from my husband and living in Pennsylvania. We are just beginning to terminate bank accounts, etc. However, my last online statement showed he had received the IRS refund**************$1300 which he promptly withdrew. And now the Stimulas refund will also be deposited. What can I do as I did not sign the form....and can I simply withdraw half of the $1300 and half of the $1200 when it appears without legal ramifications? Thanks - I am disabled and really need the financial help. He quit his job when I left him and our medical benefits were terminated. I am in the process of the SSI procedures, and welfare assistance programs.What is the name of your state?

When did you separate from your husband? If it was a joint tax return he seriously broke the law, but the refund and stimulous payment would also be marital property, subject to division in a property settlement.

I left him February 8, 2008. Not sure if he filed joint or not - but thought I should be entitled to some of this.

Did he file the return without your okay?

Refund and stimulus check should be part of your division of assets.
