I live in new york, we separated in december2000. my wife gave me her w-2 in january to do the taxes knowing that it would be used to pay off past debt. know she says she is going to press charges against me for using her social security number without her permission and falsifying documents unless she gets half. the problem is ive already payed off some debt with it. my income was a little over 23000.00 and hers was a little over 1300.00. we have two kids. my guestion is is she entitled to half legally. i did the taxes over the internet where you didnt need a signiture for federal but i did sign her name on the state like i usually did in the past.
