should she be filingWhat is the name of your state?texas My husbands 2 sons mother owes us back support. We were told we would recieve her income tax returns until all back support was paid. We have never recieved any form of tax return from her. I found out that she didnt even file last year because her return wasnt worth her paying to have them filed. Shouldn't she still file? Isn't it against the law not to file. She says she was told she did not have to file unless she owed money in. Is this true? Just wondering how this is suppose to work. Thank you to any one who can help. |

| If her gross income for the year(2003 in this case?) were under $7800, then no, she would not need to file. |

| While technically she is required to file if her income is over $7800, if her withholding was enough to cover her tax liability (assuming single filing status), the IRS doesn't care if she files or not. The US Government will be more than happy to keep her refund. Can you have the state garnish her wages for you?

| The state does garnish her wages when she works. But she has gotten very good at avoiding that. She quits her job about every three months. She owes 10,000 in back support as of January its probably closer to 12,000 by now since she kept missing payments and the intrest. we will probably never see the money. |
