Social Security Widow Benefits

A friend has decided to divorce her present husband as she has just been informed that her Social Security Widow's benefits would have been greater (about 10K per year) if she hadn't married the present husband until AFTER she was 60 years old.

She is going to divorce the present husband and turn around and marry him again.

How much trouble (if any) will they get into? How long should they wait to remarry after the divorce is finalized to keep the red flags from coming up?

The Social Security people say that "people do this all the time" But couldn't exactly tell them whether it's legal or not.

Only a practitioner, familiar with the administration of SS would know the answer to such a question. It might be a good idea for you to hire such an attorney for advice.

This is not a tax question, so the odds are slight that anyone comining to this tax forum would have an answer for you. Although it is not directed towards SS questions, you might have a better chance at getting an answer in our Estate Planning Forum.
