What is the name of your state (only U.S. law)? New York

I am wondering if my wife can be held responsible for my tax debt if she is due a refund for a year prior to us being married and filing jointly.

We filed together for 2015 - I owe

We filed separate in 2014 - I owe, she is due a refund

Any insight would be greatly appreciated.

Her separate filed refund can not be offset against your separate filed tax debt. It WILL be used for your joint filed tax debt.

Her 2014 refund will be used towards your 2015 joint tax debt. You both owe for 2015 because you filed a joint return.
