What is the name of your state (only U.S. law)? NY

How long after a person has passed away does another person have to file for the deceased?

Was probate opened/ When? When did the person die? Who do you think is supposed to file for the deceased?

No probate opened, died 2002,(deceased had income of SS and pension and also still worked) had only 1 adult child
Its way too late now...if the IRS didn't attempt to force a tax return filing by now, its not going to happen. What kind of assets did the deceased own, and how were they distributed without probate?

PRobate should have been opened or the executor of the estate should have filed in 2003 at latest. That didn't happen. LD or others may be able to go into more detail and explain whether it is too late to file. You definitely wouldn't get a refund back.
