Still waiting for company to send W2c


What is the name of your state? California

My boyfriend moved early this year, before W2s would be sent out, but it still took the company until only a couple days before April 15th to get his W2 to him as they kept sending to his old address hundreds of miles away. He began his taxes, only to find he will need a corrected W2 as the company over-held by substantial amounts on two of the taxes, and so filed an extension. In the several weeks since then, he's placed several calls to the company to get this straightened out so he can file. The first time he actually got to talk to the correct person, after calling several times, getting voice mail, and leaving messages that weren't returned, he was assured things would be taken care of. More than a week went by with no word and so he called back, go a hold of the new correct person as the previous one had just left the company, and was again told they'd correct the situation right away. Now if they had, I wouldn't be here asking what to do. A couple more weeks have gone by, and big surprise, no corrected W2 and no repayment of the taxes they over-held.

What should he do to proceed? It's pretty clear that that they have no intention of rectifying the situation. Is there someone they can be reported to? Some way of forcing them to take care of this? Or does he just have to eat the loss of a thousand dollars in over-held taxes? It looks like he's due a refund, and we're in a position right now where we need that money desperately.

What taxes were overwithheld that can't be dealt with by filing the tax returns? Overwithholding for state and federal income taxes, social security and medicare taxes are all handled via the tax returns.
