| A student on an F/J/M/Q visa is a nonresident alien for 5 calendar years, regardless of how many days they spend in the US. A nonresident alien cannot claim a standard deduction amount (usually) and often can't claim dependents. A worker with an H visa is a resident for tax purposes when they have been in the US for 183 days. [To calculate days in the US, you add all the days present during the current year, 1/3 of the days from the prior year, and 1/6 of the days from the year before that.] Usually, the year you switch from an F to an H visa, you are considered a dual status alien. Such fun for the tax preparer!
