Tax deduction


What is the name of your state?CT

Im a south asian,My divorce is almost finalized (we have been seperated for 3 years), Meanwhile im asked to pay 2500$ per month for maintainence but the problem is my spouse is living in south asia(spouse dont have social security id or no tax id), can i claim that money as tax deduction??

US tax laws require you to withhold 30% of the gross alimony paid to a non-resident alien. If you withhold the required amount & send it to the IRS, you can deduct the gross alimony paid on your tax return. Your spouse will need to file a US tax return to get any money back.

Alimony means money a court requires you to pay pending a divorce or after a divorce. Voluntary or negotiated payments are not alimony.

I have the taxid but my spouse is currently not living in USA, can i use that id and claim the tax deduction

Yes. You claim the alimony paid as an adjustment to income on Form 1040.
