tax on disability pay

What is the name of your state? california
I had surgery and was off work from 4/27/06 to 7/16/06. I filed for state disability but somehow the paperwork got screwed up by my employerand never got filed. Because of my union contract, my employer paid me my regular salary while I was out.
My previous time on disability a few years back, the paperwork had no problems so I got disability pay with my employer making up the difference of my monthly salary until I returned. In that period, my disability pay was not taxed.
Even though I got full pay this time, can I claim that period as disability pay and have the income reported as non tax for income tax purposes?

No.

The payments do not fall under the exceptions to taxability.
