| The support payments are not deductible; however, you are entitled to the dependency exemption for the children: (1)if your ex agrees, or (2) if your divorce decree gives you the right to it. | I don’t know if the fact that you and the mother were not married helps, but it does change the rule. In that case, you may take the dependency exemption for the children if you provide more than half their support. See Publication 17 for the definitions of what is and what is not support, and for a form you can use to determine if you provide more than half. |
