Taxes on settlement? What is the name of your state (only U.S. law)? New Jersey but corporate office is in Virginia I recived a settlement from my previous employer for non-punitive damages. I have not worked for this company in 2years. When I recived the check I noticed that 50% of the check was taken out for tax purposes and the check was as if I was still an employee. I have no job and have zero income because I am on long term disability. No taxes should have been taken out of a settlement check and I should have received a W-9 form which I did not. What are my rights and what should I do? Last edited by applepie1; 10-28-2009 at 11:27 PM. |

| The settlement was for wages and are taxable as such. When you file your taxes next year, if too much was withheld it will be refunded like a normal tax refund.
