Unmarried parents: Federal Income Tax QuestionWhat is the name of your state? Virginia Does the non-custodial parent have to claim the dependent every year on their tax if they make more money than the custodial parent? My son's mother and I have always alternated years claiming him on our tax returns. My friend said that the IRS contacted his sister and told her that her and her kid's dad can't alternate years because the person who makes the most has to claim the child. I've never received this communication from the IRS, is this true? My lawyer never mentioned this to me, I've never heard of such a thing. |

| The lawyer didn't mention it because there is no such rule.

| I didn't think there was... He said he had a letter from the IRS that they sent his sister he could show me. I might have to ask to see it just for chuckles. |
