W-9 & 1099 questions


What is the name of your state (only U.S. law)? PA
my story is;
in june of 2008 i was asked by my girlfriends mother if i would like to earn some extra money by doing misc office work/labor for her small business. since then i have earned around $2000 and assumed it was under the table since i was never told that it would be reported come the end of the year. last week she asked me for my SSN and address so she could fill out a W-9 for me. i have been told by many people this means that she is 1099'ing me and i am responsible for all taxes of my income from her. it is now feb 2 and have not received anything.
my questions are;
  • Is that what a W-9 does?
  • will i need to pay those taxes?
  • how do i handle a 1099 if need be?
  • i thought by law i had to have everything by jan 31, or are 1099 treated differently?

please help me

A 1099 is like a W2 in that it reports income to you and on your behalf, to the IRS.

Yes, you will need to include the income on your tax return and pay tax on it.

You put the income on a Schedule C

Employers must send everything by 1/31. That doesn't necessarily mean that you will have everything by 1/31...and some employers are simply late in getting it done.

I may not have been proper for her to pay you via a 1099. You may meet the qualifications to be regarded as an employee and therefore she should have done proper withholding and paid employer taxes and should have given you a W2. There are things that can be done about that, if that is the case, but its awkward since she is your girlfriend's mother.

By the way, the W-9 is nothing more than a request for your SSN (taxpayer ID). It means nothing, but usually means that some non-employee income is coming your way (interest, dividends, contractor payments, etc...).

Thank you for the information. you confirmed my fear. is there any way to determine at this point how about how much i will have to pay in on that 1099?
would you advise that i try and get her to put me as an employee for this year?
What can be done about it not being done proper?
because im pretty sure that i can be classified as an employee. she has told me that i am to be there Tuesday and Thursday, she pays me $10/hour and on average i get 7 hours a week.
also she never mentioned a 1099, only a W-9. i understand what a W-9 is, but is a W-9 a step before a 1099?
