What constitutes a tax nexus?


What is the name of your state? New Jersey

I am planning to open an internet site - the site is a ready-made turnkey, hosted and operated by a company in Washington State ... I live in NJ ... They permit me limited customizations to the site, but it is fundamentally an "AS-IS" situation. I presumably "own" the site; I pay an annual fee for them to host it for me, and it is my responsillity to promote the site (buy advertising). The company processes the sales transaction through their merchant account and handles fullfillment. I receive the net profits of the sale from them.

They do not collect Sales taxes, and I have no control over this since they control the software; but they do (allegedly) pay taxes to WA, in accord with some arrangement they have.

I am operating as an unincorporated sole proprietor under an unregistered business name (Me, DBA business-name). Does the mere fact that I personally live in NJ, establish a presence in NJ for my business?

If you mean whether or not you have to pay taxes to NJ, yes, you do.

Luckily for you however, WA has no state income tax.
