What is the name of your state (only U.S. law)? florida-employer refuses to reclassify me es employee after filing improper 1099's putting salary down as non employee compensation and not showing federal taxes that were taken out. irs has placed a fed lead for 10's of thousands om the credit report. they have kept thousands of dollars in my returns. filed an ss-8 and was found to be an employee by the irs.What is the name of your state (only U.S. law)?

Contact your state attorney general as there are likely civil and criminal statutes regarding willful misclassification of employees. As for the non-reported withholdings, use your paystubs to report them on the return.
 
Use IRS Form SS-8 for criteria. Perhaps consider filing dispute with the IRS. If you are correct, IRS can provide you remedy and employer could be responsible for employment taxes in addition to penalties and interests.
